It said that the ring never affected him, when he put it on, he didn't turn invisible, he gave it away without wanting it.
The ring did not make him invisible, which indicates that he is at least equal to a Maia in power. After all, the ring slips the user into the unseen world only because they do not have a body there. Sauron's physical form is a construct and not actually him - meaning it does not vanish. Same with other Maiar.
He is far more powerful than any Maia, however. That much is clearly evidenced.
The Valar would never act as he does and they are all accounted for at the time. Tom is not a Valar.
That leaves Eru and a manifestation of the earth - or the Music.
I personally like to think of him as the manifestation of the Music of the Ainur before it was corrupted by Melkor's influence. But that's just because I like that end.

I seem to like evil as well, just to think of their power, then having the most powerful good and evil fighting and thinking how it would affect the characters we know and love. I wanna see tom fight
