When on the map Moria Great Halls you can recapture Balin's tomb at any given time after it has been captured by the enemy team.

Balins tomb can still be recaptured at any given time.

It is also next to impossible to recapture the Tomb without sneaking it after all the other flags have been taken. The Dwarves spawn too far away and the Orcs spawn too close.
It's not a bug.
