I think we can violate the EULA in such ways as long as we don't go over the true meaning of it: preventing non-Mojang associated projects from making money off Minecraft.
You see, EULA is basically telling us not to make money off Minecraft. It restricts us from legally using the game to run our own personal profits. Mojang is actually ok with servers having donation systems, as can be seen by the attitude before the recent change in EULA. Now, Mojang restricts donations in an attempt to reduce the amount of servers who are making money. I'm not talking something like EW, but those that charge $200 so you can be far OP compared to others.
So, if Tim or anyone else DOES NOT make personal profits off this server, then I am satisfied to say that we are doing what is right.
