I was interested in seeing how this would affect Empire War. And just as every other server - there is no real solution. The fact is, the EULA has always been there and it is only now being recognized because it's being pressured. It hasn't been changed to such a degree. It has remained practically the same ever since Mojang decided to cover all financial ends. They have ever right to stop ignoring the blatant abuse and illegal monopolization of Minecraft servers. There is no possible chance you could ever take this successfully to court as server owners have always been - or those who actually read the rules governing money within Minecraft - aware of it and it is implied that they understood the consequences. That, and Mojang can hire a bunch of very good lawyers as Cookie mentioned.
Just, stop ignoring it. Comply with it, as it only takes a report from a single player to take a server down. Who knows; the next person you ban may want to shut you down for revenge. Stop complaining about how unfair it is since it's perfectly acceptable and justified. Since they've decided to pressure the issue, they must be absolutely sure it won't affect them in a greatly negative manner.
